Buyer:
The buyer of the product is any natural person or legal entity that purchases the products through the Internet store in the manner regulated by these General Terms and Conditions.
The Buyer selects at least one product, puts it in the cart, sends the order to the Seller, and after his order confirmation, pays in one of the possible ways (by credit card, e-banking, bank transfer or post transfer).
General provisions
1.1. These General Terms and Conditions are available to Customers at any time and can be saved, reused and reproduced.
1.2. The General Terms and Conditions regulate the relations between the Buyer and the Seller regarding the terms and manner of ordering the product, product prices, terms and methods of payment, terms of the guarantee for the correctness of the sold item (so-called guarantees), the Buyer’s right to a written complaint termination of the contract, conditions of ordering and delivery of the Product, protection of personal and other data and other issues important for concluding a contract of sale through the Internet store.
1.3. The General Terms and Conditions of the Internet Store form an integral part of every sales contract concluded between the Seller and the Buyer in this way.
1.4. Prior to purchase, the customer declares in the application that he has read these General Terms and Conditions and consequently accepted them, and that he is aware that the product order includes payment of the purchase price and shipping costs, where applicable, and that he is informed of conditions, deadlines and the procedure of exercising the right to unilateral termination of the sales contract, and that he understood and accepted all conditions and notices.
1.5. The buyer, a natural person, can only be an adult and person with legal capacity. The contract may be concluded in the name and on behalf of the minor and the completely incapable person by their legal representatives or guardians. Partially persons with legal capacity may conclude a contract only with the consent of their legal representative or guardian. The Seller shall not be liable for any act contrary to this provision.
1.6. Customers are required to provide accurate, valid and complete personal information when completing the registration form. The contrary conduct of the Buyer authorizes the Seller to refuse to sell the product or provide its services.
1.7. The Seller is authorized, in accordance with its business policy, without the need for prior notice, to change the content of the General Terms and Conditions, sales range of products, retail prices and other information related to the Internet store.
1.8. Due to the nature of access to the website, the Seller is not liable for any damage that may occur on the devices and / or in connection with the devices of the Buyers accession by the Internet store, as well as in case of inability to use the Internet store by the Buyer for the reasons that the Seller cannot influence.
1.9. The deadline for payment of the purchase price of the product (the amount stated on the confirmed order) is 3 (three) working days from the day when the Buyer receives the notification of the Seller about the confirmed order. In the event that the Buyer does not pay the purchase price within that period, and the Seller and the Buyer have not agreed otherwise, the order confirmation becomes non-binding for the Seller and it is deleted from the system.
Methods of payment
2.1 Credit card - In the Internet store you can pay 100% securely for goods ordered by credit card. We accept the following credit cards, MasterCard®, Maestro® and Visa®.
2.2. As a rule, the payer must be a person or a legal entity that is the recipient of the ordered product. In cases where the payee and the payer are not the same person, as well as in the case when the payer is not a Croatian citizen, the right to additional verification of the payer’s identity and his previous written statement via e-mail that the payer agrees to pay for the ordered goods conditions, deadlines and procedure for exercising the right to unilateral termination of the contract.
After sending an order with this method of payment, the content of the order, the final amount, the delivery address and other agreed terms cannot be changed. When the Buyer wants to change any of the above, it is necessary to cancel the order and payment and make a new order.
2.3. Payment by cards with the WSPay™ system - Payment with the WSPay™ system is made through the online platform of WSPay™ and enables payment once or in installments from Visa, MasterCard, Maestro. The minimum amount for purchase in installments is 66,36 EUR.
2.4. Until the full payment of the purchase price, the ordered products remain the property of the Seller even when they have already been delivered to the Buyer.
2.5. The invoice is delivered to the Buyer with the received goods. The invoice can also be obtained via e-mail, if the Customer has marked e-mail for correspondence.
Prices
3.1. All prices are retail prices and do not include VAT. The taxpayer is not in the VAT system, VAT is not calculated on the basis of Art. 90 paragraph 1 and paragraph 2 of the Law on VAT (Official Gazette No. 73/13).
All prices on the web shop are expressed in kunas. You can choose to display the price in euros, but keep in mind that in this way you only get the informative value according to the CNB exchange rate, while the payment itself is in HRK.
All payments will be effected in Croatian currency. The amount your credit card account will be charged for is obtained through the conversion of the price in Euro into Croatian kuna according to the current exchange rate of the Croatian National bank. When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion there is a possibility of a slight difference from the original price stated in our web site.
iSQUARE reserves the right to change retail prices, unless otherwise stated (in the case of sales campaigns and other special types of sales). Retail prices are valid at the time of receipt of the order and are not predetermined. Retail prices are valid in case of payment by the above methods and under the above conditions.
3.2. Validity of the special offer - the duration and conditions of the sales campaigns and other special forms of sale (special sale, sale, seasonal discount, etc.) are listed with each such offer.
The Buyer’s right to unilaterally terminate the sales contract
4.1. The buyer has the right, without giving reasons for this to unilaterally terminate the contract of sale concluded through the Internet store, within 14 (fourteen) days from the day when he or the person designated by him as the recipient, who is not the carrier, the product is handed over. The Buyer may do so by any unequivocal written statement expressing his will to terminate the concluded sales contract, sent to the Seller at iSQUARE, Zagorska ulica 22, 10 000 Zagreb, or e-mail info@tvojatapeta.com, in which the statement will state his name and surname, address, telephone number, e-mail and information about the received product.
4.2. The Seller is obliged to deliver to the Buyer without delay an acknowledgment of receipt of the statement of termination of the contract. In the event that the Buyer terminates the contract, the Seller will return to the Buyer no later than 14 (fourteen) days from the date of receipt of the returned Product, the full amount paid, less shipping costs when it exists, in accordance with these General Terms, in the same manner as the payment is made, unless the Buyer expressly agrees to some other means of payment and on the assumption that the Buyer is not obliged to pay any additional costs for such refund. The refund of the amount paid will be made to the Buyer only after the Seller receives the product at the address indicated on the invoice or confirmation that the product has been sent to the Buyer’s address.
4.3. The cost of returning the goods on the basis of unilateral termination of the contract by the Buyer shall be payed by the Buyer.
4.4. The Buyer has previously acknowledged that he has received this notice of the right to unilaterally terminate the contract by ordering the product in the Seller’s application.
In the event of termination of the contract by the Buyer as stated above, to refund the entire amount received, the returned products must be unused, undamaged and in undamaged original packaging with a copy of the invoice attached.
4.5. The buyer is liable for any impairment of the goods, which is the result of handling the goods, except that which was necessary to determine the nature, characteristics and functionality of the product, therefore:
4.5.1. - in case of damaged or missing packaging of the product, do not take over the product but return it to the Seller with a note about the defects of the packaging, otherwise it is considered that the product was taken over with undamaged packaging;
4.5.3. - if the product has visible damage (eg broken or missing part, damage in the form of scratches, cracks, etc.) it is necessary to inform the seller as soon as possible;
4.5.4 - Seller is liable for material defects of the product.
Product availability and delivery time
The delivery time of the product from the day of ordering the product is 3-5 working days.
Delivery time may be extended in the event of events that the Seller could not have foreseen or prevented. In both cases, the Buyer will be notified in a timely manner of the estimated delivery time in the manner prescribed by these conditions.
5.1. Delivery time is 3-5 working days after sending the order.
5.2. Delivery of products to the Customer is performed exclusively on working days during the working hours of delivery services. The buyer will be contacted in advance to agree on a delivery date.
5.3. Delivery is free for orders above 60,00 EUR for Croatia and Slovenia. For other EU countries, please contact us.
5.4. Purchased Products will be delivered in accordance with the above if the address indicated for delivery can be accessed from the public transport area by means of transport.
5.5. In the event that the Buyer is not present during the delivery in person, the purchased products may be picked up by another adult specified by the Buyer in the order or in a note. The person who takes over the purchased product and all accompanying documents at the time of handover states his name and surname, the property of connection with the Customer, the date of receipt and signs the handover documentation.
Security
6.1. The seller uses appropriate technological and organizational means to protect the transfer and storage of personal data, orders and payments. The seller is certified by the banks and has a contractual relationship with the banks. The online store uses WSPay™ - a secure system for online credit card authorization in real time.
6.2. WSPay™ takes care of the confidentiality and security of your data when authorizing credit cards. The WSPay™ system, among other security features, uses PCI DSS certification.
6.3. Your credit card number is not available to Internet store employees at any time. Only the authorized transaction number is available to them. They have the authority to charge the transaction in full or in part, or to cancel the transaction. The customer is responsible for access to their system and will take care of securing user data and passwords. The buyer guarantees the accuracy and truthfulness of all submitted data and is liable to the seller for damage caused by inaccurate or untrue data.
Communication
7.1. All communication related to the ordering process and the conclusion of the sales contract between the Seller and the Buyer is done via e-mail and / or telephone number that the Buyer enters during the registration process.
7.2. Notices of monthly promotions and advertising emails sent by the Seller to the Buyer must be clearly and unambiguously marked as advertising messages. The sender must be clearly visible. The Seller will unconditionally respect the wish of the Buyer or the User not to receive advertising messages and notifications about monthly promotions.
Exemption from liability
8.1. The seller makes every effort to ensure the consistency and timeliness of the information published on the website. Nevertheless, the characteristics of the products, their condition in the warehouse and the price may change so quickly that the Seller fails to update the information on the website in time. In this case, the Seller will notify the Buyer of the changes as soon as possible and allow him to cancel the order or replace the ordered product.
8.2. All photos on the web shop are illustrative and do not necessarily have to be identical to the product. The seller reserves the right to make errors in the description and images of the product. The seller is not responsible for any errors in the description of the product, images and errors caused by changes in prices and page updates.
Written customer complaints and disputes
9.1. These General Terms and Conditions have been prepared in accordance with the Consumer Protection Act and other regulations of the Republic of Croatia. Buyers may submit their written complaints about the Seller’s products or services directly at the business premises at the Seller’s registered office or send them to the Seller’s address by mail or e-mail as specified in the Seller’s data.
9.2. iSQUARE reserves the right to refuse to cooperate with customers who behave inappropriately (aggressive communication, threatening messages, etc.).
Any attempt to insult honor and reputation will be prosecuted in a competent court.
9.3. The Seller is obliged to confirm without delay that he has received the written complaint of the Buyer, inform the Buyer how long its processing will take and inform him in due time about the course of the procedure, and no later than 15 (fifteen) days from the date of receipt of the written complaint.
9.4. The Seller and the Buyer will make every effort to resolve possible disputes amicably, and if they fail to do so, the Buyer may submit a report to the Court of Honor of the Croatian Chamber of Commerce or submit a proposal for conciliation to the authorized Conciliation Centers. Proceedings before the courts of honor are conducted in accordance with the Ordinance on the Court of Honor at the Croatian Chamber of Commerce, and before conciliation centers in accordance with the Conciliation Act and the Ordinance on conciliation of the selected conciliation center. In case of a dispute before the court, the court in whose territory the residence of the Seller is located has jurisdiction.
European Commission Regulation no. 524/2013 on online resolution of consumer disputes, which has been applied since 09.01.2016, the Platform for online resolution of consumer disputes (Platform for ORS) has been put into use.

For consumer disputes in relation to traders from the Republic of Croatia, this possibility does not exist until the procedure is supported by the necessary legislation by the authorized bodies of the Republic of Croatia. All user data is strictly kept and is available only to employees who need this data to do their job. All iSQUARE employees and business partners are responsible for adhering to the principles of privacy protection.
iSQUARE takes technical and organizational security measures to protect your personal data from accidental or unlawful destruction, loss or alteration, and from unauthorized disclosure or access. User data is only available to employees who need this data to do the job.
The user can access personal information on our Website using a password and e-mail address. The user is advised not to disclose the password to third parties. The user is aware of the fact that no data transmission over the Internet, or any wireless network can be 100% secure.
